Summary
Authorizes prosecutors to seek an enhanced sentence of an additional term of imprisonment of up to 10 years for larceny involving stolen cargo.
Issue
Amends the Michigan Penal Code to newly authorize prosecutors to seek an enhanced sentence of an additional term of imprisonment of up to 10 years for larceny involving stolen cargo. Prosecutors would be required to include a statement that the defendant is subject to the enhanced sentence on the complaint and information. If the
enhanced sentence is imposed, it would have to run consecutively to any term of imprisonment imposed for another violation arising from the same transaction.
Cargo would mean goods, chattels, money, or baggage that constitutes, in whole or in part, a commercial shipment of freight moving in commerce, from a pipeline system,
railroad car, truck, or other vehicle; from a tank or storage facility, station house, platform, or depot; from a vessel or wharf; from an aircraft, air terminal, airport, aircraft
terminal, or air navigation facility; or from an intermodal container, intermodal chassis, trailer, container freight station, warehouse, freight distribution facility, automobile
loading facility, automobile holding lot, or freight consolidation facility. Cargo would not include direct-to-consumer goods.
Moving in commerce would mean all points from the point of origin to the final destination, regardless of any temporary stop while awaiting transshipment or otherwise.
