Issue
Modifies and updates the requirements used by the Texas Commission on Environmental Policy for ozone reduction attainment to include “Cargo Handling Equipment” under the program available for incentives. "Cargo handling equipment" means any heavy-duty non-road, self-propelled vehicle or land-based equipment used at a seaport or rail yard to lift or move cargo, such as containerized, bulk, or break-bulk goods. Modifies existing “Drayage” truck incentives defined as a heavy-duty on-road or non-road vehicle that is used for drayage activities and that operates in or transgresses through [truck that transports a load to or from] a seaport or rail yard for the purpose of loading, unloading, or transporting cargo, including transporting empty containers and chassis. The incentives are directed to drayage trucks and cargo handling equipment with pre-2007 model year engines, to encourage replacement with newer drayage trucks and cargo handling equipment. The drayage truck or cargo handling equipment must operate in a non-attainment area of the state for not less than 50 percent of the truck ’s or equipment ’s [vehicle ’s] annual mileage or hours of operation. The incentive provided may be used to fund not more than 80 percent of the purchase price of the drayage truck or cargo handling equipment.
